{"id":3428,"date":"2023-04-19T10:04:59","date_gmt":"2023-04-19T08:04:59","guid":{"rendered":"https:\/\/dev.digitecmedia.com\/munozmontanes\/?p=3428"},"modified":"2025-07-04T12:38:48","modified_gmt":"2025-07-04T10:38:48","slug":"novedades-reglamento-ordenacion-navegacion-maritima","status":"publish","type":"post","link":"https:\/\/dev.digitecmedia.com\/munozmontanes\/novedades-reglamento-ordenacion-navegacion-maritima\/","title":{"rendered":"NOVEDADES INTERESANTES DEL REGLAMENTO DE ORDENACI\u00d3N DE LA NAVEGACI\u00d3N MAR\u00cdTIMA"},"content":{"rendered":"\n<h4 class=\"wp-block-heading\">El pasado 22 de marzo de 2023 se public\u00f3 el <a href=\"https:\/\/www.boe.es\/diario_boe\/txt.php?id=BOE-A-2023-7410\" target=\"_blank\" rel=\"noreferrer noopener\">Real Decreto 186\/2023<\/a> por el que se aprueba el Reglamento de Ordenaci\u00f3n de la Navegaci\u00f3n Mar\u00edtima. <\/h4>\n\n\n\n<h4 class=\"wp-block-heading\">Procedemos a mencionar aqu\u00ed algunos de los aspectos m\u00e1s interesantes del mismo:<\/h4>\n\n\n\n<h5 class=\"wp-block-heading\"><strong>1.<\/strong> <strong>EMBARCACIONES DE RECREO:<\/strong><\/h5>\n\n\n\n<p>El Reglamento establece un r\u00e9gimen simplificado para agilizar el despacho de embarcaciones de recreo cuya solicitud es obligatoria cuando realicen labores comerciales (principalmente ch\u00e1rter n\u00e1utico).<\/p>\n\n\n\n<h5 class=\"wp-block-heading\"><strong>2. AUTORIZACION DE ESTANCIA<\/strong>:<\/h5>\n\n\n\n<p>Se crea un r\u00e9gimen de autorizaci\u00f3n\/prohibici\u00f3n de entrada y salida de buques en los espacios mar\u00edtimos en los que Espa\u00f1a ejerce soberan\u00eda, derechos soberanos o jurisdicci\u00f3n, cuya regulaci\u00f3n no estaba concretada hasta ahora.<\/p>\n\n\n\n<h5 class=\"wp-block-heading\"><strong>3. REGULACION DE FONDEO DE BUQUES<\/strong>:<\/h5>\n\n\n\n<p>Todos los buques que lleven a bordo sustancias contaminantes o representen un peligro potencial y quieran fondear en el espacio mar\u00edtimo nacional, aunque sea fuera de las aguas territoriales, est\u00e1n obligados a notificarlo a la Capitan\u00eda Mar\u00edtima correspondiente.<\/p>\n\n\n\n<h5 class=\"wp-block-heading\"><strong>4. OPERACIONES FUERA DE LIMITES<\/strong>:<\/h5>\n\n\n\n<p>Se regulan las operaciones que se realicen (sin mediar fondeo) por buques o embarcaciones en aguas interiores mar\u00edtimas o en el mar territorial, pero siempre fuera de las aguas de la zona de servicio portuario. Estas operaciones pueden ser el aprovisionamiento de v\u00edveres, pertrechos, repuestos, entrega de piezas o equipos, transbordo de tripulantes y personas ajenas a la tripulaci\u00f3n o al pasaje.<\/p>\n\n\n\n<p>Se proh\u00edbe, dentro de estas operaciones, los transbordos de carga, la transferencia, suministro o bombeo de combustibles o de cualquier otra sustancia y las reparaciones mayores.<\/p>\n\n\n\n<h5 class=\"wp-block-heading\"><strong>5. INFRACCIONES Y SANCIONES:<\/strong><\/h5>\n\n\n\n<p>Respecto a las infracciones y sanciones GRAVES, si bien se remite a la <a href=\"https:\/\/www.boe.es\/buscar\/act.php?id=BOE-A-2011-16467\" target=\"_blank\" rel=\"noreferrer noopener\">Ley de Puertos<\/a>, procede a \u201crenombrar\u201d algunas de dichas infracciones o incluir nuevos apartados, entre otros:<\/p>\n\n\n\n<p>Las que perjudiquen gravemente a la seguridad mar\u00edtima:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Entrada de buques en espacios mar\u00edtimos sin autorizaci\u00f3n.<\/li>\n\n\n\n<li>Realizar actividades excluidas de operaciones fuera de l\u00edmites sin autorizaci\u00f3n.<\/li>\n\n\n\n<li>Detenerse o fondear sin autorizaci\u00f3n expresa.<\/li>\n\n\n\n<li>Estorbar el tr\u00e1nsito en las aguas de servicios de buques.<\/li>\n\n\n\n<li>Incumplir las condiciones de fondeo de buques tanque o que transporten sustancias nocivas para el medio ambiente.<\/li>\n<\/ul>\n\n\n\n<p>A su vez, y en cuanto a las sanciones correspondientes a las infracciones graves recogidas en el <a href=\"https:\/\/www.boe.es\/diario_boe\/txt.php?id=BOE-A-2023-7410\" target=\"_blank\" rel=\"noreferrer noopener\">Reglamento<\/a>, se establecen par\u00e1metros y graduaci\u00f3n en las multas. Esto no exist\u00eda antes. Se fija un m\u00ednimo y m\u00e1ximo de la posible sanci\u00f3n, dependiendo de que se trate de: embarcaciones, buques de menos de 45 metros de eslora o buques de m\u00e1s de 45 metros de eslora.<\/p>\n\n\n\n<p>Debemos mencionar que las novedades del <a href=\"https:\/\/www.boe.es\/diario_boe\/txt.php?id=BOE-A-2023-7410\" target=\"_blank\" rel=\"noreferrer noopener\">Reglamento <\/a>son pocas, para un texto de 55 art\u00edculos.
